Sweepstakes may only be entered in or from the 50 United States (void in Rhode Island and Puerto Rico), the District of Columbia and Canada (void in Quebec) by legal residents who are 18 years of age or older. Entries originating from any other jurisdiction are not eligible for entry. Entrants may not be members of any guild, union, or other organization that may prohibit them from participating in this Sweepstakes and that would restrict, require due payment or otherwise have the right to oppose such Entrant’s participation in this Sweepstakes. This Sweepstakes is governed exclusively by the laws of the United States. You are not authorized to participate in the Sweepstakes if you are not a legal resident within the 50 United States (void in Rhode Island and Puerto Rico) or the District of Columbia or Canada (excluding Quebec) and/or under the age of 18 years.
1. Entry Period: Bose #SoundLinkSceneSweeps Sweepstakes (the Sweepstakes). The Sweepstakes entry period begins at 8:00:00 AM Eastern Time (“ET”) on July 30, 2015 and ends at 11:59:59 PM ET on August 30, 2015 (the “Sweepstakes Period”). Mail-in Entries (”AMOE”) must be postmarked no later than the end date.
2. How To Enter: You may enter the Sweepstakes by submitting a Photograph of your scene from the Bose Speaker’s point of view or via the AMOE in accordance with below.
PHOTOGRAPH ENTRY: During the Sweepstakes Period, take a photograph of your scene from the Bose Speaker’s point of view (“Photograph”) (It is not necessary to own a Bose SoundLink® speaker to enter. Post a photograph of a scene or special place where you wish you could have or use a Bose SoundLink® speaker), describe the scene or activity (“Description”) and submit the Photograph and Description through Instagram as outlined below. All Photographs must comply with the Entry Guidelines and Requirements defined below:
Instagram Entry. Upload and share the Photograph and your Description of the scene or activity from your Bose Speaker’s point of view to your public Instagram account; including the hashtag #SoundLinkSceneSweeps in the text area. Entrant’s Instagram settings must be public (you must make sure the “Photos Are Private” option in the account settings on your Instagram account are set to “OFF”). Entries uploaded from private Instagram accounts will not be eligible. You must have an Instagram app and account to enter via this method. If you do not have the Instagram app, you may download it through the application store on your device. The Instagram app is free.
IMPORTANT: MESSAGE AND DATA RATES MAY APPLY TO THE USE OF MOBILE DEVICES TO PARTICIPATE IN THE SWEEPSTAKES. You should consult your wireless service provider's pricing plan for details. You agree to incur any and all charges demanded by your wireless carrier. You should also check your device's features for capabilities and check the device manual for specific use instructions
Sponsor may not receive entries from Instagram users with “protected” updates or profiles that are not public (i.e., user has set the account so that only people the user has approved can view updates).
Alternate Entry Method: Mail-in Entry. To enter by Mail-in Entry, entrant must send their Photograph and Description including entrant’s name, address, telephone number, email address, the phrase #BoseSounLinkSceneSweeps; and mail with proper postage to Bose Corporation, Attn: c/o #SoundLinkSceneSweeps AST Marketing, 100 Mountain Road, Framingham, MA 01701. Mail-in entries must be postmarked by the last day of the Sweepstakes Period. All mailed entries must be postmarked by August 30, 2015 and received by September 4, 2015.
The Sponsor is not responsible for late, lost, misplaced, illegible, mutilated, incomplete or undelivered entries and such entries will be deemed invalid.
All entry information, including all Photographs, Descriptions, and posts shall be collectively referred to herein as the “Entries” or each as an “Entry.” Entries must comply with the Guidelines and Requirements defined below.
Limit one (1) Entry per person per week during the Sweepstakes period regardless of method of entry. Limit one (1) Prize per person and/or household for the entirety of the Sweepstakes period. Entrants are not permitted to submit an Entry (“Submission”) more than once per week during the Sweepstakes Period. Duplicate Submissions by the same person will be subject to disqualification. All terms and conditions of Instagram.com apply. Multiple entrants are not permitted to share the same Instagram account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different Instagram accounts, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any Instagram Entry, the authorized account holder of the email address used to register on the platform will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.
All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, postage-due, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Sweepstakes.
3. Random Drawings/Odds: Sixty (60) winners in total, 10 winners per week during the Sweepstakes period, will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period July 30, 2015 – August 30, 2015. Drawings will be conducted by Sponsor, whose decisions in all matters relating to this Sweepstakes are final. Odds of winning a sweepstakes prize are dependent upon the total number of entries received during the Sweepstakes Period.
4. Winner Notification: Potential winners will be notified on or about Monday of each week except the last week in which case winners will be notified on or about September 4, 2015, and may be required to sign and return, where legal, an Affidavit or Declaration of Eligibility, Liability/Publicity Release and/or rights transfer document (collectively, “Affidavit”) within five (5) days of receipt.
Potential winners that entered via Instagram Entry will be notified by Sponsor via direct message and/or comment or reply to his/her public Entry (the “Initial Notification”). Potential winners must respond within 48 hours to provide an email or mailing address. If the winner does not respond with their email or mailing address within 48 hours of the Initial Notification or if the Affidavit (if applicable) is not returned and received within 14 days of the date emailed or mailed to the potential winner, the prize will be forfeited.
Potential winners that entered via Mail-in Entry will be confirmed via email and/or phone (the “Initial Notification”), and must respond within 48 hours to provide an email or mailing address. If the winner does not respond with their email or mailing address within 48 hours of the Initial Notification or if the Affidavit (if applicable) is not returned and received within 14 days of the date emailed or mailed to the potential winner, the prize will be forfeited.
At the sole discretion of Sponsor, disqualification and forfeiture may result from any of the following: (1) a potential winner’s failure to respond to notification in the time frame designated by Sponsor; (2) the return of an email notification as undeliverable; (3) a potential winner’s failure to provide Sponsor with satisfactory proof of age, identity, and residency; (4) a potential winner’s failure to validly claim the prize within 48 hours of the notification attempt; and (5) any other non-compliance with the Official Rules. In the event of forfeiture, the prize may be awarded to an alternate (time permitting). Upon prize forfeiture, no compensation will be given.
5. Entry Guidelines and Requirements: All Instagram Entries must comply with the following minimum Guidelines and Requirements defined below.
· Entrants are required to upload an appropriate Photograph and Description using the Instagram application;
· Photograph and Description caption/post must include the hashtag #SoundLinkSceneSweeps for Instagram Entries;
· Entrants must be registered users of Instagram to submit an Instagram Entry and must comply with the respective company’s Terms of Use in order to enter the Sweepstakes;
· Entrants may be required to provide appropriate releases (as supplied by Sponsor) for each person shown in the Photograph in order for the Photograph to be eligible to win;
· Once an Entry has been submitted, it cannot be modified by entrant;
· Entry cannot contain material that violates or infringes any rights of any other party, including but not limited to copyright, trademark, privacy, publicity or any other intellectual property rights;
· Entry cannot be profane, pornographic, sexually explicit or suggestive or contain nudity;
· Entry cannot promote or in any way include or reference alcohol, illegal drugs or tobacco;
· Entry cannot defame, misrepresent or contain disparaging remarks about people or companies;
· Entry cannot contain an image that defaces or depicts any product in a negative or inappropriate light;
· Entry cannot be obscene or offensive, endorse any form of hate or hate group or be derogatory to any ethnic, racial, gender, religious, professional or age group;
· Entry cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
· Entry cannot depict illegal activity and cannot itself be in violation of any law;
· Entry must not include any private information of a third party such as name, address, phone number, or email address;
· Entry must conform with the format and size requirements and limitations of Instagram;
· Entry cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means.
By submitting your Entry, you agree to grant Sponsor a world-wide, royalty-free perpetual, irrevocable, non-exclusive license to use, distribute, reproduce, modify, adapt, create derivative works from, and publicly perform or display such content, in whole or in part, on a worldwide basis, in perpetuity, and to incorporate it into other works, in any form, media or technology now known or later developed, including, but not limited to, on the Bose Instagram, Twitter, and/or Facebook pages or through any other means, for any purpose whatsoever, including for promotional or marketing purposes.
By entering, you warrant and represent the following with respect to your Entry: (a) you are the sole and exclusive owner of the Entry; (b) your Entry will not infringe on any rights of any third parties.
You acknowledge that other entrants may have used ideas and/or concepts in their Submission that may be similar in idea or concept to what is included in your Entry. You understand and agree that you shall not have any claim against any other entrant or Sponsor arising out any such similarity or be entitled to any compensation because of any such similarity.
6. Prizes: Sixty (60) winners will each receive a Bose prize of a Bose SoundLink mini series II speaker system (approximate retail value $199.95). Each winner is solely responsible for all applicable federal, state, and local taxes on the value of the prize won. Each prize winner may be issued an IRS 1099-MISC tax form for the retail value of the prize won. Prizes are non-transferable. No substitutions or cash redemptions. In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value.
Winners are responsible for all prize related costs or expenses not specifically exempted herein. No more than the stated number of prizes will be awarded. Limit one (1) prize per person or household.
7. Eligibility: The Sweepstakes is open to legal residents of the fifty (50) United States, the District of Columbia (except residents of Rhode Island and Puerto Rico) and Canada (void in Quebec), who are 18 years of age or older and the age of majority in their state of residence at the time of entry. Void in Rhode Island, Puerto Rico, Quebec and wherever else prohibited by law or regulation. Entrants may not be members of any guild, union, or other organization that may prohibit them from participating in this Sweepstakes and that would restrict, require due payment or otherwise have the right to oppose such Entrant’s participation in this Sweepstakes. Employees, officers and directors of Bose Corporation (“Sponsor”), and its parent company, subsidiaries, affiliates, partners, advertising and promotion agencies, participating retailers, manufacturers or distributors of promotion materials, and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees, officers and directors are not eligible to enter.
8. Conditions. BY PARTICIPATING, ENTRANTS AND WINNERS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR INSTAGRAM AND THEIR ADVERTISING AND PROMOTIONS AGENCIES AND THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS (COLLECTIVELY, “RELEASED ENTITIES”), FROM ANY AND ALL LIABILITY, FOR LOSS, HARM, DAMAGE, INJURY, COST OR EXPENSE WHATSOEVER INCLUDING WITHOUT LIMITATION, PROPERTY DAMAGE, PERSONAL INJURY AND/OR DEATH WHICH MAY OCCUR IN CONNECTION WITH, PREPARATION FOR, TRAVEL TO, OR PARTICIPATION IN SWEEPSTAKES, OR POSSESSION, ACCEPTANCE AND/OR USE OR MISUSE OF PRIZE OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY AND FOR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT OR ANY OTHER INTELLECTUAL PROPERTY-RELATED CAUSE OF ACTION. Participation in Sweepstakes and acceptance of prize constitutes each winner’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. Sponsor is not responsible if Sweepstakes cannot take place or if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.
9. Additional Terms. Any attempted form of entry other than as set forth above is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. Released Entities are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Sweepstakes, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or web site. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Limitation of Liability: IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND APRTICIPATIN IN THE SWEEPSTAKES AND/OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. By entering, entrants agree to be bound by these Official Rules and any rules or guidelines required by Instagram.
11. Dispute Resolution: The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the Commonwealth of Massachusetts. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of Suffolk in the Commonwealth of Massachusetts.
THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, and exclusively before a court located in Massachusetts having jurisdiction. By participating in this Sweepstakes, Canadian Entrants are authorizing the transfer of personal data to the United States for purposes of administering the Sweepstakes.
13. Winners List: For the names of the winners, send a self-addressed envelope only, with your return address to: Winners List, c/o #SoundLinkSceneSweeps Sweepstakes, AST Marketing, Bose Corporation, The Mountain, Framingham, MA 01701. Requests must be received by October 15, 2015. Names of winners will be available only after winners have been verified and prizes officially awarded.
