There is only
one method of entry. On February 1, 2015
(“Promotion Period”), Entrant is required to re-tweet hashtag #Bosegiveaway. Failure
to disclose #Bosegiveaway will disqualify the entry. Entries must be sent from
a public Twitter account. Re-tweets will
not be judged. In the event of a dispute as to any entry, the authorized
account holder of the Twitter account used to enter will be deemed to be the
participant. The authorized account holder is defined as the natural person who
is assigned to a use name by Twitter. Participants must enter using only a Twitter
account subscribed to and registered in his/her name. The potential winner may
be required to provide Sponsor with proof that he/she is the authorized account
holder of the Twitter account associated with the winning entry. Automated
entries (including but not limited to entries submitted using any robot, script, macro or other automated service) are
not permitted and will be disqualified. We do not claim ownership of content
submitted by users without compensation by Bose and with the expectation that
such content will be made publicly accessible through the Bose Twitter page. By
submitting such content, however you agree to grant us world-wide, royalty-free
perpetual, irrevocable, non-exclusive license to use, distribute, reproduce,
modify, adapt, create derivative works from, and publicly perform or display
such content on the Bose Twitter page or through any other means. No other methods of entry will be
accepted. The Sponsor is not responsible for late, lost, misplaced, illegible,
mutilated, incomplete or undelivered entries and such entries will be deemed
invalid. All entries become the property of Sponsor and will not be
acknowledged or returned.
Entries
must be complete with all information to be eligible for sweepstakes entry. Limit one (1) entry per person or twitter account.
Entering invalid personal information or multiple registrations will result in immediate
disqualification. All submitted entries become the property of Bose Corporation
(“Sponsor”) and will not be returned.
2. Drawings:
Two (2) Grand Prize winners
and Thirteen (13) Runner Prize winners will be selected via random drawings from
among all eligible entries received before the applicable drawing date. Winners will be selected on February 1,
2015 by midnight (12:00) Mountain Time. Drawings will be conducted by Sponsor,
the judge of the Sweepstakes, whose decisions in all matters relating to this Sweepstakes
are final. At the sole discretion of Sponsor, disqualification, forfeiture and
the selection of an alternate winner may result from any of the following: (1) a potential winner’s failure to respond
to notification promptly after its transmission; (2) the return of an email
notification as undeliverable; (3) a potential winner’s failure to provide
Sponsor with satisfactory proof of age, identity, and residency; (4) a
potential winner’s failure to validly claim the prize within 2 days of the
notification attempt; and (5) any other non-compliance with the Official
Rules. In the event of prize forfeiture,
Sponsor will award the forfeited prize to an alternate winner. Winners will be notified via Twitter , and must
respond within 48 hours and provide an email or mailing address in order to
receive an Affidavit of Eligibility and Liability/Publicity release (where
permitted by law), which must be completed and returned to Sponsor. If the
winner does not respond with their email address within 48 hours of
notification or if the Eligibility and Liability /Publicity Release is not returned
and received within 14 days of the date emailed or mailed to the potential
winner, an alternate winner will be randomly selected from the remaining pool
of participants received for the original drawing.

Prizes may not be
transferred or redeemed for cash, in whole or in part. Each Grand Prize winner is solely responsible
for transportation and any other costs associated with travel to and attending
the game. Each winner is solely
responsible for all applicable federal, state, and local taxes on the value of
the prize won. Each prize winner will be issued an IRS 1099-MISC tax form for
the retail value of the prize won. No substitutions for prizes, except by
Sponsor as may be due to unavailability. If
originally offered prize is unavailable at the time of award, Sponsor may
substitute an item of comparable value. Winners are responsible for all prize
related costs or expenses not specifically exempted herein. No more than the stated number of prizes will
be awarded. Odds of winning a sweepstakes prize are dependent upon the total
number of entries received.
4. Eligibility:
The sweepstakes is open to
legal residents of the United States (except residents of Rhode Island, Puerto
Rico, and all other US Territories and Possessions and all overseas Military
Installations) who are 18 years of age or older at the time of entry. Void in
Rhode Island, Puerto Rico and wherever else prohibited by law or regulation.
Not open to employees and their families (spouses, parents, children/siblings
and their respective spouses, and those living in the same household) of Bose Corporation
and their affiliates, subsidiaries, participating retailers, advertising and
production agencies. Entrants consent to the use of their registration
information in accordance with the Bose privacy
policy.
5. Limitation
of Liability:
Sponsor
and judging organization are not responsible for typographical or other errors
in any promotion-related materials, or for any individual's inability to enter
this promotion, including, but not limited to, unavailable network, server, or
other connections; failed software or hardware transmissions; other errors of
any kind, whether human, mechanical, or electronic, including lost, late,
incomplete, damaged, or misdirected entries; or for any damage to any computer
related to or resulting from participation. Multiple entries and those generated
by script, macro, or other automated entry devices are not valid and will be
disqualified. Sponsor reserves the right in its sole discretion to cancel or
suspend the promotion should any of the foregoing occurrences corrupt or impair
the administration, security, fairness, or proper play of the sweepstakes. In
the event that the promotion is cancelled for any reason, including but not
limited to those listed above, winners will be determined via random drawings
from entries received up to the time of cancellation.
By
entering, each entrant agrees to defend, indemnify, release and hold harmless
Sponsor, its promotion partners, its related companies, agencies, and
respective employees or officers from and against any and all losses, demands,
damages, rights, claims, injuries, actions and liabilities of any kind arising
out of or related to (i) entrants participation in the Sweepstakes or (ii)
entrant’s participation in any prize-related activities (including, without
limitation, any property loss, damage, personal injury or death caused to any
person(s)). Prize winners assume all
liability for any injury, death or damage caused or allegedly caused in whole
or in party by participating in this Sweepstakes or receipt, use or redemption
of the prize.
Participants acknowledge that they are providing information to
Sponsor and not to Twitter. Twitter does not endorse this promotion in any way. Twitter
is not a sponsor or an administrator of this promotion, nor is it affiliated or
associated with the promotion or responsible for fulfillment of prizes. By entering, participants agree to be bound by these
Official Rules and any rules or guidelines required by Twitter.
6. Dispute Resolution:
THIS SWEEPSTAKES IS
GOVERNED BY THE LAWS OF THE UNITED STATES AND THE COMMONWEALTH OF
MASSACHUSETTS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of
participating in this Sweepstakes, participant agrees that any and all disputes
which cannot be resolved between the parties, and causes of action arising out
of or connected with this Sweepstakes, shall be resolved individually, without
resort to any form of class action, exclusively before a court located in
Massachusetts having jurisdiction. Further, in any such dispute, under no
circumstances will participant be permitted to obtain awards for, and hereby
waives all rights to claim punitive, incidental, or consequential damages,
including reasonable attorneys' fees, other than participants' actual
out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes),
and participant further waives all rights to have damages multiplied or
increased.
