Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. How To Enter:
There are two ways to enter. Between June 6, and July 21, 2014 (Promotion Period), (1) Entrant must take a photo of her or himself wearing or trying on Bose headphones, Upload the photo with the captions "#ListenForYourself" and "#BoseStoreSweeps" and Follow Bose on Instagram. Failure to disclose both captions "#ListenForYourself" and "#BoseStoreSweeps" with the uploaded Instagram photo will disqualify the entry. Entries must be sent from a public Instagram account. Photos will not be judged. In the event of a dispute as to any entry, the authorized account holder of the Instagram account used to enter will be deemed to be the participant. The authorized account holder is defined as the natural person who is assigned to a use name by Instagram. Participants must enter using only an Instagram account subscribed to and registered in his/her name. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the Instagram Account associated with the winning entry. Automated entries (including but not limited to entries submitted using any robot, script, macro or other automated service) are not permitted and will be disqualified. We do not claim ownership of content submitted by users without compensation by Bose and with the expectation that such content will be made publicly accessible through the Bose Instagram page. By submitting such content, however you agree to grant us world-wide, royalty-free perpetual, irrevocable, non-exclusive license to use, distribute, reproduce, modify, adapt, create derivative works from, and publicly perform or display such content on the Bose Instagram page or through any other means.(2) By Mail-in Entry. No other methods of entry will be accepted. To enter by mail-in entry, participant must fill out a 3X5 post card with participant’s name, address, telephone number and email address, and mail postage paid to Bose Corporation, Attn: Fulfillment, 100 Mountain Road, Framingham, MA 01701. Mail-in entries must be received by the end of the Promotion Period. The Sponsor is not responsible for late, lost, misplaced, illegible, mutilated, incomplete or undelivered entries and such entries will be deemed invalid. All entries become the property of Sponsor and will not be acknowledged or returned.

Entries must be complete with all information to be eligible for sweepstakes entry. Limit one (1) entry per person or email address. Entering invalid personal information or multiple registrations will result in immediate disqualification. All submitted entries become the property of Bose Corporation ("Sponsor") and will not be returned.

2. Drawings:

12 Winners will be selected via random drawings from among all eligible entries received before the applicable drawing date. Entries will be considered for each drawing that occurs after the date of receipt of his/her entry, unless such entry is selected as a winning entry. Winners will be selected on or about end of business on each of the following dates: June 16, June 23, June 30, July 7, July 14, and July 21, 2014. Drawings will be conducted by Sponsor, the judge of the Sweepstakes, whose decisions in all matters relating to this Sweepstakes are final. At the sole discretion of Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) a potential winner’s failure to respond to notification promptly after its transmission; (2) the return of an email notification as undeliverable; (3) a potential winner’s failure to provide Sponsor with satisfactory proof of age, identity, and residency; (4) a potential winner’s failure to validly claim the prize within 2 days of the notification attempt; and (5) any other non-compliance with the Official Rules. In the event of prize forfeiture, Sponsor will award the forfeited prize to an alternate winner. Winners will be notified via Instagram, and must respond within 48 hours and provide an email or mailing address in order to receive an Affidavit of Eligibility and Liability/Publicity release (where permitted by law), which must be completed and returned to Sponsor. If the winner does not respond with their email address within 48 hours of notification or if the Eligibility and Liability /Publicity Release is not returned and received within 14 days of the date emailed or mailed to the potential winner, an alternate winner will be randomly selected from the remaining pool of participants received for the original drawing.

3. Prizes:

12 Prizes: Each prize consists of one pair FreeStyle^™ earbuds and one pair of SoundTrue^™ headphones ("Prize"). Approximate total retail value of each Prize is $329.90. Prizes may not be transferred or redeemed for cash, in whole or in part. Each winner is solely responsible for all applicable federal, state, and local taxes on the value of the prize won. Each prize winner will be issued an IRS 1099-MISC tax form for the retail value of the prize won. No substitutions for prizes, except by Sponsor as may be due to unavailability. If originally offered prize is unavailable at the time of award, Sponsor may substitute an item of comparable value. Winners are responsible for all prize related costs or expenses not specifically exempted herein. No more than the stated number of prizes will be awarded. Odds of winning a sweepstakes prize are dependent upon the total number of entries received.

4. Eligibility:

The sweepstakes is open to legal residents of the United States (except residents of Rhode Island, Puerto Rico, and all other US Territories and Possessions and all overseas Military Installations) who are 18 years of age or older at the time of entry. Void where prohibited by law or regulation. Not open to employees and their families (spouses, parents, children/siblings and their respective spouses, and those living in the same household) of Bose Corporation or Live Nation Worldwide, Inc., and their affiliates, subsidiaries, participating retailers, advertising and production agencies. Entrants consent to the use of their registration information in accordance with the Bose privacy policy. All federal, state, and local laws and regulations apply.

5. Limitation of Liability:

Sponsor and judging organization are not responsible for typographical or other errors in any promotion-related materials, or for any individual's inability to enter this promotion, including, but not limited to, unavailable network, server, or other connections; failed software or hardware transmissions; other errors of any kind, whether human, mechanical, or electronic, including lost, late, incomplete, damaged, or misdirected entries; or for any damage to any computer related to or resulting from participation. Multiple entries and those generated by script, macro, or other automated entry devices are not valid and will be disqualified. Sponsor reserves the right in its sole discretion to cancel or suspend the promotion should any of the foregoing occurrences corrupt or impair the administration, security, fairness, or proper play of the sweepstakes. In the event that the promotion is cancelled for any reason, including but not limited to those listed above, winners will be determined via random drawings from entries received up to the time of cancellation.

By entering, each entrant agrees to defend, indemnify, release and hold harmless Sponsor, Live Nation Worldwide, Inc., its promotion partners, its related companies, agencies, and respective employees or officers from and against any and all losses, demands, damages, rights, claims, injuries, actions and liabilities of any kind arising out of or related to (i) entrants participation in the Sweepstakes or (ii) entrant’s participation in any prize-related activities (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)). Prize winners assume all liability for any injury, death or damage caused or allegedly caused in whole or in party by participating in this Sweepstakes or receipt, use or redemption of the prize.

Participants acknowledge that they are providing information to Sponsor and not to Instagram. Instagram does not endorse this promotion in any way. Instagram is not a sponsor or an administrator of this promotion, nor is it affiliated or associated with the promotion or responsible for fulfillment of prizes. By entering, participants agree to be bound by these Official Rules and any rules or guidelines required by Instagram.

6. Dispute Resolution:

THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Massachusetts having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participants' actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.

7. Winners List:

For the names of the winners, send a standard-size postcard, only, with your return address to: Winners List, c/o Bose® RDG Social Headphones Sweepstakes Bose Corporation, Attn: Andrew Allain, The Mountain, Framingham, MA 01701. Requests must be received by August 31, 2014. Names of winners will be available only after winners have been verified and prizes officially awarded. Do not send entries or other correspondence to this address.
