YouTube Channel House Rules

Introduction

Welcome to the Bose® brand channel on YouTube! The Bose Channel is maintained by Bose Corporation (“Bose,” “we,” “us”). These House Rules (these “House Rules”) govern your (“you” “your” or a “user”) access to and use of[www.youtube.com/user/bose and its subdomains (the “Bose Channel”), and the features made available through the Bose Channel (“Features”). By using the Bose Channel, you indicate you are 18 years of age and indicate your unconditional acceptance of these House Rules. Please read these House Rules carefully, as they may have changed since your last visit.

The Bose Channel is intended to be a place for Bose users to discuss Bose products and services and for users to view and upload video, images, text, links and other content (“Content”). You may be permitted to post questions and comments on the Bose Channel. When providing comments or information, you understand that such comments and information are your sole responsibility, and that Content is the sole responsibility of the person from whom such Content originated. You understand that Bose does not control, and is not responsible for, Content made available by users on the Bose Channel, and that by using the Bose Channel, you may be exposed to Content from other users that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. Please also note that the Content may contain typographical errors, other inadvertent errors or inaccuracies.

Bose may offer sweepstakes from time to time, and if and when we do, they will be subject to separate rules and subject in all respects to being permissible under applicable law.

Bose Privacy Notice and YouTube Terms

Please note that YouTube is a Google service and independent of Bose. On YouTube, Bose is a guest on an external media platform. These House Rules and the Bose Privacy Policy (as defined below) apply in addition to the YouTube terms and conditions of use and other policies of YouTube. All Vide entries shall comply with YouTube Terms of Service and Community Guidelines. Please carefully review both these House Rules and the YouTube policies.

Protecting the security and privacy of your personal data is important to Bose. We conduct our business in compliance with applicable laws on data privacy protection and data security. Google also has its own data protection rules. Accordingly, Google collects information that users provide and information from the use of its services by users. Google may process and use this information in accordance with its terms of use and data privacy policy. Bose has no influence on Google’s activities. User Content

You understand that the Bose Channel is available for your personal, noncommercial use only. All Content provided by a user on this page shall be deemed to be non-confidential, and Bose shall have no obligation of any kind with respect to such material. Information and other Content on the Bose Channel may be protected by intellectual property rights of others. Please do not copy, upload, download, or share files unless you have the right to do so. By providing material as a user of our page, you agree that you have the rights and are authorized to provide such material and that doing so (a) is not in violation of any applicable law or regulation, and (b) does not infringe the copyright, trademark, trade secret or other intellectual property rights of others. Content posted by users on the Bose Channel does not necessarily reflect the opinions or ideals of Bose Corporation, nor is Bose responsible for the accuracy of Content posted by visitors to the Bose Channel. Content posted to the Bose Channel may be monitored by Bose Corporation. All Content posted by users must comply with YouTube’s terms of use. Further, Bose expects users of this Bose Channel to respect fellow users and comply with Bose intellectual property rights. Users may not remove author attributions or legal information in any file that is uploaded, nor may users falsify or intentionally misattribute the origin or source of those files. Bose reserves the right to remove content that in its sole discretion is deemed inappropriate or offensive, including but not limited to:

• Advertisements of any kind, including competitor advertisements, item sale, solicitation, self-promotion, and spam.

• False, inaccurate, or misleading information.

• Personal or corporate attacks, including attacks on Bose, its employees, suppliers, distributors, and affiliates.

• Irrelevant content, including misleading material, or that which portrays Bose in an inaccurate manner.

• Material that threatens, harasses, or otherwise violates the legal rights of others, including material that reveals the privacy or personal information of other users.

• Content that contains any malware, software programs or files that may violate the intellectual property rights of any party, or include offensive content, or damage other users’ viewing devices.

Bose may also remove material if it receives notice from a third party that your Content infringes that third party’s rights. Bose, in its sole discretion, may choose not to respond to each and every posting. Bose reserves the right to block users from participating on the Bose Channel who in Bose’s sole discretion fail to adhere to these House Rules.

You warrant that any Content that you provide to the Bose Channel complies with these House Rules. You agree to indemnify Bose against all actions and claims arising from Content that you have posted or uploaded to, or your acts or omissions in connection with, the Bose Channel.

We will remove submitted Content from our channel upon the user’s written request. Users can request their submitted Content be removed by emailing SocialMarketing@bose.com

Intellectual Property Rights

Unless otherwise noted, all Content contained on the Bose Channel is the property of Bose and/or its affiliates or licensors, and is protected from unauthorized copying and dissemination by United States copyright law, trademark law, international conventions and other intellectual property laws. Product names are trademarks or registered trademarks of their respective owners.

We do not claim ownership of Content submitted by users without compensation by Bose and with the expectation that such Content will be made publicly accessible through the Bose Channel. By submitting such Content, however, you agree to grant us a world-wide, royalty-free, perpetual, irrevocable, non-exclusive license to use, distribute, reproduce, modify, adapt, create derivative works from, and publicly perform or display such Content on the Bose Channel or through any other means.

The Bose Channel may contain links to third party channels, web pages or websites (“Non-Bose Channel Content”). Non-Bose Channel Content is not endorsed by Bose. Governing Law; Jurisdiction

The Bose Channel is operated by Bose from its offices in Framingham, Massachusetts, in the United States of America. We make the Content and Features available on the Bose Channel in the U.S. and its Territories. We make no representation that information on the Bose Channel is appropriate or available for use outside the United States. Those who choose to access the Bose Channel from outside the United States do so on their own initiative and at their own risk and are responsible for compliance with applicable local laws.

These House Rules shall be governed and interpreted pursuant to the laws of the Commonwealth of Massachusetts, United States of America, without regard to the conflict of law provisions thereof. All claims, legal proceedings, or litigation arising in connection with the Bose Channel will be brought solely in federal or state courts located in the Commonwealth of Massachusetts, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum. You covenant not to bring a claim in any other forum. Each party hereto acknowledges and agrees that any controversy which may arise under these House Rules is likely to involve complicated and difficult issues, and therefore each such party irrevocably and unconditionally waives any right such party may have to a trial by jury in respect of any litigations directly or indirectly arising out of or relating to these House Rules.

Miscellaneous

These House Rules control the relationship between Bose and you for the Bose Channel. We may, at our sole discretion and without notice, revise these House Rules at any time by updating this posting. If you do not agree to the modified House Rules for the Bose Channel, you should discontinue your use of the Bose Channel.

If you do not comply with these House Rules, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future). If it turns out that a particular term is not enforceable, this will not affect any other terms.
